Acceptance of Terms

By accessing, browsing, registering on, or otherwise using The Writora ("thewritora.com", "the Platform", "we", "us", or "our"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional guidelines, policies, or rules that may apply to specific sections of the Platform or to products and services offered through the Platform, all of which are incorporated by reference into these Terms.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and The Writora. If you are using the Platform on behalf of an organisation, company, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and all references to "you" shall refer to that entity.

If you do not agree to any part of these Terms, you must immediately cease using the Platform, close any account you may have created, and refrain from accessing any content hosted on The Writora. Continued use of the Platform following the publication of any amendments to these Terms constitutes your acceptance of those amendments.

You must be at least 13 years of age to use this Platform. By accepting these Terms, you represent that you are at least 13 years old. If you are under 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Use of the Platform

The Writora is a multi-author digital publishing platform that provides access to articles, essays, opinion pieces, and other written content produced by independent authors and contributors ("Content"). The Platform is made available for personal, non-commercial reading and engagement purposes unless expressly agreed otherwise in writing.

Subject to your compliance with these Terms, The Writora grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your own personal, non-commercial purposes. This licence does not include any right to resell or make commercial use of the Platform or its Content; collect and use any product listings, descriptions, or prices; make any derivative use of the Platform or its Content; download or copy account information for the benefit of another merchant; or use data mining, robots, or similar data gathering and extraction tools.

All rights not expressly granted to you in these Terms are reserved by The Writora and its licensors. You agree that your use of the Platform will comply with all applicable local, national, and international laws, regulations, and ordinances. You agree not to interfere with the Platform's infrastructure, security systems, or technical delivery mechanisms, and not to attempt to gain unauthorised access to any portion of the Platform or any system or network connected to it.

The Writora reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time without notice or liability. We may also impose limits on certain features and services or restrict your access to parts or all of the Platform without notice or liability. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

User Accounts

To access certain features of the Platform — including saving bookmarks, posting comments, following authors, and purchasing a Premium subscription — you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself, and to keep that information accurate, current, and complete throughout your use of the Platform. Providing false or misleading information, impersonating another person, or creating an account on behalf of another person without authorisation is strictly prohibited and may result in immediate termination of your account.

You are solely responsible for maintaining the confidentiality and security of your account credentials, including your email address and password. You are responsible for all activity that occurs under your account, whether or not you authorised it. You agree to immediately notify The Writora at [email protected] if you suspect any unauthorised use of your account or any other security breach. The Writora will not be liable for any loss or damage arising from your failure to protect your account credentials.

You may not share, transfer, or assign your account to any other person or entity. Each account is intended for use by a single individual. The Writora reserves the right to terminate accounts, remove or edit Content, or cancel orders at our sole discretion, particularly where we believe that a user has violated these Terms or applicable law. Upon termination of your account for any reason, your right to use the Platform will immediately cease.

Accounts that have been inactive for a period of 24 consecutive months may be subject to deletion after reasonable prior notice by email. You may request deletion of your account at any time by contacting [email protected]. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

The Writora offers a voluntary Premium subscription ("Premium Plan") that grants subscribers full access to all premium and exclusive content published on the Platform. The Premium Plan is priced at $3.00 USD per month, displayed at this rate for your convenience. Payments are processed in Kenyan Shillings (KES) at the prevailing equivalent rate at the time of checkout through our payment processor, Paystack.

All payment transactions are processed exclusively by Paystack, a PCI-DSS compliant payment service provider. The Writora does not store, access, or retain your full card details, mobile money PINs, bank account numbers, or any other sensitive financial credentials. By initiating a payment, you agree to Paystack's own Terms of Service and Privacy Policy, which govern their handling of your payment information. The supported payment methods available at checkout include:

Each successful payment grants you exactly 30 days of Premium access from the date of payment confirmation. Subscriptions are non-recurring by default — your subscription does not renew automatically at the end of the 30-day period. You will not be charged again unless you actively initiate a new payment. You will receive an email reminder before your current subscription period expires so that you may choose to renew.

In the event of a failed payment, network error, or payment gateway timeout, no funds will be debited from your account and no Premium access will be granted unless the transaction is confirmed as successful. If you believe you were charged but did not receive Premium access, please contact [email protected] immediately with your transaction reference number.

Refund Policy

7-Day Money-Back Guarantee

Not satisfied within the first 7 days? Contact [email protected] for a full refund — no questions asked.

The Writora offers a 7-day money-back guarantee on all new Premium subscriptions. If you are not fully satisfied with your Premium subscription for any reason within the first seven (7) calendar days of your initial payment, you are entitled to request a full refund of the amount paid. To claim your refund, send an email to [email protected] from the email address registered to your account, stating your request and including your payment transaction reference if available. Refunds will be processed within 5–10 business days and returned to the original payment method used, subject to your payment provider's processing timelines.

After the 7-day guarantee period has expired, all payments are final and non-refundable. We do not issue partial refunds for unused days within a 30-day subscription period. If your subscription was purchased as part of a promotional offer, the specific terms of that promotion will govern eligibility for refunds and may override the standard 7-day policy.

The Writora reserves the right to refuse refund requests where there is evidence of fraudulent activity, abuse of the refund policy, or where the same account has previously received a refund. Any dispute regarding a payment or refund that cannot be resolved through our support channel may be referred to Paystack's dispute resolution process or to the relevant consumer protection authority in your jurisdiction.

Cancellation

You will never be charged automatically. Each renewal requires your explicit action.

Premium subscriptions on The Writora are structured as one-time, non-recurring payments. Each successful payment grants exactly 30 days of Premium access. Your subscription will not automatically renew at the end of your subscription period, and you will not be charged without your explicit authorisation and action to initiate a new payment.

If you have an active Premium subscription and wish to cancel it before the end of your 30-day period, you may do so at any time through your account settings or by using the "Cancel subscription" option on the Plans page. Upon cancellation, your Premium access will remain active until the end of the current 30-day period for which you have already paid. No pro-rated refund will be issued for the remaining days of an active period unless a refund is requested within the 7-day guarantee window described in Section 5.

Following the expiry of your current subscription period, your account will revert to free-tier status. You will continue to have access to all free content on the Platform, but access to premium and exclusive content will be restricted until you choose to renew your Premium subscription. The Writora may send you a reminder email prior to the expiry of your subscription period to give you the opportunity to renew.

The Writora reserves the right to suspend or terminate your subscription and access to the Platform without refund if we determine, in our sole discretion, that you have violated these Terms of Service, engaged in fraudulent activity, or misused the Platform in a way that causes harm to other users, authors, or the Platform itself.

Intellectual Property

All Content published on The Writora — including articles, essays, analyses, photographs, illustrations, graphics, and other creative works — remains the exclusive intellectual property of the respective author or rights holder who submitted it. Authors who publish on the Platform retain all copyright, moral rights, and related rights in their work. The Writora does not claim ownership over any author-submitted content.

By submitting Content to the Platform, authors grant The Writora a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, display, reproduce, and distribute their Content through the Platform and through reasonable promotional or editorial channels, including social media, newsletters, and partner integrations, for the purpose of operating and promoting the Platform. This licence does not transfer ownership of the Content, and authors may request removal of their Content from the Platform at any time by contacting the editorial team.

All trademarks, service marks, logos, brand names, trade names, and domain names of The Writora, including "The Writora" and "thewritora.com", are owned exclusively by The Writora. You may not use, copy, reproduce, or display these marks in any manner without our prior written consent. Unauthorised use of our trademarks may constitute trademark infringement and unfair competition under applicable law.

Users of the Platform are strictly prohibited from reproducing, distributing, publicly displaying, publicly performing, making derivative works from, or transmitting any Content from the Platform without the express prior written permission of the relevant author or The Writora. Short quotations with proper attribution for the purpose of commentary, criticism, or news reporting may be permitted under applicable fair use or fair dealing doctrines, but users are responsible for ensuring their use complies with applicable law. Any infringement of intellectual property rights may result in civil and/or criminal liability.

Prohibited Conduct

The Writora is committed to maintaining a safe, respectful, and intellectually honest community. By using the Platform, you agree not to engage in any of the following prohibited activities:

  • Posting, transmitting, or distributing any content that is defamatory, obscene, pornographic, harassing, hateful, threatening, abusive, violent, discriminatory, or otherwise objectionable under applicable law.
  • Impersonating any person, business, or entity, including The Writora staff, authors, or other users, or misrepresenting your affiliation with any person or organisation.
  • Submitting knowingly false or misleading information, including fabricated news, deliberate misinformation, or plagiarised content presented as original work.
  • Using the Platform to send unsolicited commercial communications (spam), chain letters, pyramid schemes, or any other form of unsolicited mass messaging.
  • Attempting to gain unauthorised access to the Platform's systems, databases, servers, or networks; engaging in denial-of-service attacks; or introducing any virus, malware, ransomware, or other harmful code.
  • Using automated bots, scrapers, crawlers, or other automated means to extract content, collect user data, or interact with the Platform in a manner not expressly authorised by these Terms.
  • Circumventing, disabling, or otherwise interfering with security-related features of the Platform, including features that prevent or restrict access to certain content.
  • Engaging in any activity that violates any applicable local, national, or international law or regulation, including but not limited to laws regarding privacy, data protection, intellectual property, and electronic communications.

The Writora reserves the right — but is not obligated — to monitor user activity and Content for compliance with these Terms. We may, at our sole discretion and without prior notice, remove any Content that violates these Terms, suspend or permanently terminate the accounts of users who engage in prohibited conduct, and report any unlawful activity to the relevant law enforcement authorities. The Writora shall not be liable for any failure to remove prohibited content or take action against any user.

Disclaimer of Warranties

The Writora and all of its Content, features, and functionality are provided on an "as is" and "as available" basis, without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, The Writora expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

The Writora does not warrant that: (a) the Platform will be uninterrupted, timely, secure, or error-free; (b) the results that may be obtained from the use of the Platform will be accurate or reliable; (c) the quality of any content, information, or other material obtained by you through the Platform will meet your expectations; or (d) any errors in the Platform will be corrected.

Content published on The Writora reflects the views and opinions of the individual authors and does not represent the official position of The Writora. We do not endorse, guarantee the accuracy of, or take responsibility for any Content posted by authors or users. While we make reasonable efforts to review content for quality standards, The Writora is not responsible for errors, omissions, or inaccuracies in any published content. You rely on any content on the Platform entirely at your own risk.

The Platform may contain links to third-party websites, services, or resources. Such links do not imply endorsement, sponsorship, or recommendation by The Writora. We have no control over the content or practices of third-party sites and accept no responsibility or liability for them. You acknowledge and agree that The Writora shall not be liable for any damage or loss caused by or in connection with your use of or reliance on any third-party content, goods, or services.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall The Writora, its operators, directors, employees, agents, affiliates, partners, suppliers, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of business opportunities, loss of goodwill, or cost of substitute services, arising out of or in connection with your use of or inability to use the Platform or any Content, even if The Writora has been advised of the possibility of such damages.

In no event shall The Writora's total cumulative liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the greater of: (a) the total amount paid by you to The Writora in the twelve (12) calendar months immediately preceding the event giving rise to the claim; or (b) one hundred Kenyan Shillings (KES 100). This limitation applies regardless of the form of action, whether based in contract, tort (including negligence), strict liability, or any other legal or equitable theory.

Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law. If you are a consumer located in a jurisdiction that provides mandatory statutory rights that cannot be excluded or limited by contract, those rights are not affected by these Terms.

You agree to indemnify, defend, and hold harmless The Writora and its officers, directors, employees, contractors, agents, licensors, suppliers, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Platform, including but not limited to Content you submit, your interaction with other users, or your violation of any third-party rights.

Changes to Terms

The Writora reserves the right to modify, amend, or update these Terms of Service at any time, at our sole discretion. Changes may be made in response to new legal requirements, changes to our services, feedback from our community, or any other reason we deem appropriate. We will not necessarily provide individual notice of every minor update, but we will make reasonable efforts to inform registered users of material changes.

When we make material changes to these Terms, we will notify registered users by sending an email to the address associated with your account at least seven (7) days before the changes take effect, and by updating the "Effective Date" displayed at the top of this page. It is your responsibility to maintain an accurate, up-to-date email address in your account settings to ensure you receive such notifications.

Your continued use of the Platform after the effective date of any revised Terms constitutes your binding acceptance of those revised Terms. If you do not agree to the revised Terms, you must cease using the Platform and, if desired, close your account before the effective date of the changes. We encourage you to review these Terms periodically to stay informed of any updates.

The most recent version of these Terms will always be accessible at thewritora.com/terms. Prior versions of the Terms may be obtained by contacting us at [email protected], although prior versions have no legal effect once a new version has taken effect.

Governing Law & Dispute Resolution

Republic of Kenya — Laws of Kenya shall govern these Terms

These Terms of Service, and any dispute, controversy, or claim arising out of or in connection with these Terms, including any question regarding their existence, validity, interpretation, performance, breach, or termination, shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

In the event of any dispute between you and The Writora, we encourage you to first attempt to resolve the dispute informally by contacting us at [email protected] with a written description of your concern. The Writora will make reasonable efforts to resolve the dispute within 30 days of receiving your written notice.

If the dispute cannot be resolved informally, any legal proceedings shall be brought exclusively in the courts of competent jurisdiction located in the Republic of Kenya, and both you and The Writora irrevocably submit to the personal jurisdiction of such courts. Nothing in this section shall prevent either party from seeking emergency injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending resolution of a dispute.

For users located in jurisdictions with mandatory consumer protection legislation that cannot be varied by contract — including but not limited to the European Union, United Kingdom, or Australia — nothing in these Terms shall deprive you of any mandatory statutory rights afforded to you under the laws of your home jurisdiction, and any mandatory legal provisions applicable to you shall apply in addition to these Terms.
